1. Acceptance of terms

By creating an account or using Formax, you agree to these Terms of Service. If you do not agree, please do not use the service.

If you use Formax on behalf of an organization, you represent that you have authority to bind that organization to these terms.

2. Your account

You are responsible for keeping your account credentials secure and for all activity that occurs under your account.

You must provide accurate information and promptly update it as needed. You must be old enough to form a binding contract in your jurisdiction.

3. Acceptable use

You agree not to use Formax to collect data unlawfully, to send spam, to infringe others’ rights, or to distribute malware or harmful content.

You are responsible for the forms you create and the data you collect, including obtaining any consent required from your respondents.

4. Intellectual property

Formax and its software, design, and branding are owned by us and protected by intellectual-property laws. We grant you a limited, non-exclusive right to use the service.

You retain ownership of the content you create and the responses you collect. You grant us only the rights needed to operate the service for you.

5. Payments and subscriptions

Paid plans are billed in advance on a recurring basis. Unless stated otherwise, fees are non-refundable except as described in our refund practices.

We may change pricing with reasonable notice. If you do not agree to a change, you may cancel before it takes effect.

6. Termination

You may stop using Formax and close your account at any time. We may suspend or terminate access if you violate these terms or use the service in a way that creates risk.

On termination, your right to use the service ends. We will make your data available for export for a reasonable period where practicable.

7. Disclaimers and liability

Formax is provided “as is” without warranties of any kind to the extent permitted by law. We do not guarantee that the service will be uninterrupted or error-free.

To the maximum extent permitted by law, our liability for any claim relating to the service is limited to the amount you paid us in the twelve months before the claim.

8. Governing law

These terms are governed by the laws of the jurisdiction in which Formax operates, without regard to conflict-of-law principles.
